3 days short for ILR!!!!!

Post by aamir nazir » Mon Feb 14, 2011 12:37 am

I need some advice regarding my visal/ILR. My details are:

UK arrival : May 2003
Permit Free Traing : Aug 2003-Aug 2007
HSMP : 2/6/2006-2/6/2008
Tier 1 : 1/5/2008-1/5/2011

I am elligible for ILR in April 2011 but you can see that i am short of 3 days(if i apply 28 days before expiry) or 31 days if i apply on time.
What options do I have and how to go ahead?

Not in April, but June.

You are eligible on 2 June 2011 (or 28 days before). How did you conclude that you can get ILR in april 2011.

I think thats just a Typo but you are still short of few days. I think you need new visa, albeit for 3 days. You sent your Tier 1 application too early without thinking about ILR eligibility date. I am not sure if you can challenge that, may be mods can help if they know of any case where such a challenge has been successful.

what is ILR extension? no such thing.

if you dont meet points requirement, solicitor cant help you. so using a solicitor for extension is down to you. However the question is do you meet total points requierment. you only mentioned that you dont get age points, what about other points? Do you meet total requirement?

From 06-Apr-11, the following technical change will become effective:
Annex B - Calculation of the qualifying period of continuous leave for settlement wrote:2.2 Applications that fall short of the five year continuous period

In some cases, applicants may have been granted 5 years continuous leave, but will not have spent 5 years continuously in the UK before their current leave expires. Caseworkers may count the period between entry clearance being granted and the date the applicant entered the UK towards the 5 years, provided this period was not longer than 3 months.
Life isn't fair, but you can be!

I was just thinking did you switched from HSMP to Tier1 or was it the extension under JR
if latter the I guess you don't have to worry about the points anymore as the new guidelines means that JR cases won't be affected by the april changes.
