Work Permit Extension. PLEASE URGENT HELP!!!

Post by ENNAFOM » Mon Feb 14, 2011 12:05 am

Can employer apply for extension after almost 5yrs into old WP? May not qualify for ILR due to complications.

Am I eligible to apply for extension under the new T2 rules or the transition arrangement (almost through to end of 5yr WP)? Is it going to be a new application under T2? I am confused as to which option to go.

Please advise.

im pretty sure your new app must be for tier 2 general as all other schemes are closed.

they must have transitional arrangement in place for old WP holder but you should check if your employer is registered on ukba register of sponsors. otherwise you cant apply for tier 2 visa!

cheers

If your employer is a registered Tier 2 sponsor, and therefore, can provide you with a CoS then you may apply for further leave to remain as Tier 2 migrant under transitional arrangements.

I think you can apply under transitional arrangements only to get your stay upto 5 years. Once that is reached you cannot extend under transitional arrangements and have to make application under Tier 2. Just wanted to add to above comments as you said
May not qualify for ILR due to complications.
Here is a link to the details

http://www.ukba.homeoffice.gov.uk/worki ... angementa/
You can apply to extend your stay until you have been in the UK in an eligible category for a total of five years.

If you have been in the UK in an eligible category for five years or more and you want to extend your stay, you must meet the full requirements for scoring points under Tier 2 (General). Alternatively, you can apply to settle here permanently if you meet the settlement requirements - the Settling in the UK section contains more information.
Thanks
