gap in long residence visa(10 years)

Post by faz28 » Sat Feb 12, 2011 11:18 pm

Hello,

I would be grateful if any one could help us. My husband came to UK on 12/09/2001, so he will be elgible to apply ilr on on sep 2011. But when we go through his visa stamps we discovered there are 2 gaps in his lawful residence, but he says all are ontime postal applications. Pls tell us whether his continuos residence is broken.

1st Stamp - 29/08/01 - 31/10/02 (69 Days)

2nd Stamp - 09/01/03 - 31/10/03 (20 Days)

3rd Stamp - 21/11/03 - 30/10/04

4th Stamp - 25/10/04 - 31/12/07

5th Stamp - 21/12/07 - 30/04/11

There is no refusals or second time applications.

If he sent his applications by post before his leave expired, then there are no gaps.

Although it would be helpful, it's not required if applying for 10 year Long residence application.

If all your visas clearly overlap, all you need to include is passport(s), photos and life in the UK test. Perhaps also include a table showing dates when you left the UK and came back (for holiday etc...) with the page number in the passport where the stamp is.

If some of your visas do not overlap but you submitted application in-time, I suggest you order your SAR file and get the evidence that you applied in-time from there and send it with your ILR application. The caseworkers may not trawl through their database to find out if you applied in-time! make it easy for them and you will get your case approved more quickly!

ILR - 10 year visa

Post by kanakojac » Sat Apr 07, 2012 12:47 pm

My husband has been here for 13 years lawfully. Is it too late to apply for IRL based on the 10 year visa?
