Workpermit toTier 1 application with 20% Bonus and over time

Hi Experts,

I am switching from Workpermit (Not Tier2) to Tier 1 (New application), based on current situation I need to earn 65K to be eligibile to Tier 1.
My total gross salary is 48850 untill Dec 2010 (Including car allowance of 4860 PA taxable). Recently (From Jan 2011) my sal is increased to 65K PA, on top of this I recieved bonus of 20% on 48850 (in Dec) and overtime for Jan and Feb of 2011 (This will satisfy the requirement of 65K for Tier 1)

Break downs:

2010

Salary : 43990
Car Allowance : 4860
Bonus 20% on 43990 : 8798

Total Earnings : 57648

2011

Gross Salary : 59460
Car Allowance : 5540
Overtime Jan & Feb : 3422

Now my questions are:

1) Will UKBA consider my car allowance as earnings? this is taxable though?
2) Bonus and over time will this be considered as earnings again?

My Solicitor has suggested me to take total gross earning PM for whole year on a company letter headed paper and get that signed by payroll department.

I suspect his suggestion of break downs on LH paper, and i am not sure if they consider my car allowance as earnings. Will this be alright if I apply for Tier 1 this type of earning?

Any advise would be much appreciated.

Your car allowance (if its reimbursement) is not considered for Earnings at all, make no mistake about that. WRT your Bonus, its not considered either (to the best of my knowledge, and others are welcome to correct me). However, your OT is countable as your income.

Don't think that is correct. All bonuses will be counted sign-on , performance etc.... your allowanances will be counted so long as these are paid to you and taxes are paid on them. Reimbursable allowances are not counted. The policy guidance clearly mentions this.

Thank you both for your reply. Yes all my income mentioned above are taxable, even my car allowance, Bonus and OT.

Any other senior members or OISC's are welcome to comment on this pls.
