Visa for Family members

Hi All,

In Jan 2011 I have received my ILR under long residency and would like to apply for my dependents visa who are living with me in UK. Currently they are on Tier 1 dependent visa. I have the following queries;

1-Two of kids are born in UK and they posses an Indian Passport issued in London by Indian High Commission. My questions is;
a. Change there visa with my wife under SET(M)? Or
b. Register them as British Citizen MN1? Or
c. Are they eligible for British passport directly?

2-My third kid who is also born in UK and is only 4 months old. He currently holds no passport. In this case;
a.Do I have to get his Indian passport first and then apply for MN1? Or
b.Can I directly apply for MN1 for him? Or
c.Is he eligible for British passport directly?

3-My wife will be applying on SET(M), correct me if I’m wrong.

4-I’m eligible to apply for any benefits such as Child Benefits and Tax credits?

I appreciate your advice on my queries.

How long has your wife lived in the UK with you?

You are entitled to all public funds / benefits that you qualify for as a settled person.

I appriciate your prompt response and is very helpful.

My wife is here with me in UK for the past 5 year on the dependent visa.

(2- years Student Dependent, 1.5 years WP dependent and rest HSMP/Tier 1 Dependent)

Your wife should apply for leave to remain as spouse of settled person (284). Use form FLR(M). New English language requirement for partners apply.

When your wife completes 2 years of stay in the UK in combination of Tier 1 (General) dependant + FLR(M) leaves, then she may apply for settlement (287(a)(d)). Use form SET(M). KOL required.
