Hello,

I was on HSMP scheme in Nov 2006.I got extension in Nov 2009 for 2 years.
I am covered by HSMP High court JR judegement.However,my current visa is Tier1 (and NOT HSMP).

My question is :
When i apply for another extension in Nov 11, will i be covered under HSMP Jr( and treated under same rules)?
OR

will i be treated as Tier1 holder and Tier1 extension rules would apply to me?

You are not covered by HSMP JR.

Hi,
Thanks for your reply...But when i had called up the contact centre of home office, i was trold that since i am originally from HSMP scheme, i will be covered.However,i wanted to double check..
Do you have any links for my situation?

Just to be clear, under HSMP JR, if you applied for HSMP before the 3rd of April 2006, you will be eligible for settlement after 4 yrs. If you applied btw 3rd of April and 7th pf Nov 2006, you will be eligible for settlement after 5 yrs and you don't need to pass life in UK test. You will need to show that you have been economically active..

ashishashah,

If you were enrolled before Nov, 2006 changes, you would be eligible to extend when your current leave expires under HSMP JR.

The only problem I see is, your clock would have been reset as you had stayed more than allowed time out of the UK. Having said that you will need to spend another 5 years in order to qualify for an ILR.

If you are just looking to extend then you will need to proove that you have been economically active.

Thanks...Yes,i was hoping that i would be covered under HSMP JR for EXTENSION.(Not for settlement).
I am not looking for ILR, i am aware that my clock would have been reset and i dont mind it..

Hello All,

I am planning to travel to UK in Sep 2011 for my 2nd extension..
I would be aplying under HSMP JR for extension..
As per the form i need to show 'economic activity ' for last 12 months..

I was working till Jan 2010 for a reputed UK firm,but i came back to India for personal reasons..
Do you feel that they might reject my 2nd extension?
