WRS registration

I`m (Russian) recently got married and would like to apply for FMRS.My husband Lithuanian passport holder.On 1.02.2011 he was employed, so we were planning to do registration with WRS by the end of the month, but he has to leave UK till 03.04.2011 because of his family circumstances. Home Office says he has to register within 1 month since the day of employment otherwise his employer can have a fine of £5000.Do you think we still can go for registration being late for 1 month?
By the end of April this registration with WRS won`t be need any more as I read on HO page. Even if we`re going to apply for his registration on 03.04.2011 as soon as he comes back to UK, and get result by the end of April ,do you think it will be still necessary for FMRS?

The rules are obviously very clear: within one month.

so we can`t register him with WRS 2 month later?
