question regarding qualifying period for ILR

Post by vella » Sun Feb 27, 2011 7:14 pm

Hi,

Could some on please advise me regarding my ILR qualifying period.

I entered on Permit training visa in UK in 2005 and later got the work permit letter dated on 24/04/2006. I sent my passport for work permit to UKBA and work permit was stamped on 05/05/2006. I am currently now on HSMP(tier1) general visa. I am eligible soon for ILR (5years in may 2011 and eligible on 7th apr2011).

My query is whether I can count the work permit letter date as the start of my qualifying period or its the date of the work permit stamp in my passport which starts the date of ILR.

Many thanks for the help

It's the date of the stamp on your passport, that's when your status changed to WP holder.

I thought it is the date on which candidate entered the UK and NOT the date on which passport was stampped.

Depends if it is an out of country application or and in-country application. If out of country, it is the date on which candidate enters UK. if in-country its the visa stamp date.

For work permit the candidate always had to leave the country to get clearance from home country. Is it considered as 'out of country' application?

Entry clearance is issued by overseas (UK) diplomatic posts and therefore is an "out-of-country" application.
