Dutch passport holder living in UK

Hi everyone
Im from Holland with the dutch nationality. I live in Uk now and want to call my husband from Pakistan to join here. Can I apply 4the spouse visa from here? What do i need, from where and how long will take?

Unless you are a permanent resident your husband will not be eligible for a spouse visa and the EEA family permit is the way to go. Here are the official processing times.

My husband applied 4 the spouse visa. I have to appeal now. I found out that we applied 4d wrong. Can w change that now? Im really worried. I cant make a fresh application cuz my hubby is not able to pass the english test. Can u give me a source which says that u dont need to pass english test?

Neither the EEA route nor the UK route require a language test at this stage. Only for naturalisation would that be needed.

It is still unclear to me what you have actually applied for and what you actually want to apply for. You do not give much useful detail of yourself and your circumstances, e.g. are you a permanent resident.

In fact the UK route does now require English language testing at the initial probationary stage.

You're right though it is not clear what application the OP's husband made and why his application was refused.

sacha001 can you confirm what visa did your husband apply for?

Ok, I stand corrected. But I see that the new settlement application form clearly asks for language skills. The form for the EEA FP certainly does not.

My husband applied 4 the spouse visa nd they refused becuz i hav no residnt permit. Im not permanent yet in the uk. So the spouse visa was wrong and i had to apply 4family permit. Can i change that now in the appeal? U hav the english test 4d spouse visa in pakistan. So does that count 4d family permit in pakistan?

No there is no english language test requirement for the EEA family permit.

Please read the link provided by 86ti above regarding the requirements for an EEA family permit. On what basis are you exercising your treaty rights in the UK? E.g. are you working, self-employed, a student, self-sufficient etc?

You should make a new application for the family permit rather than pursue the appeal as the application seems to have been refused for the correct reasons.

If you have the permanent right of residence, then continue with the appeal. Else, he may apply for an EEA family permit.

they say that they are not satisfied that I am a EEA national family member according to regulation 6 of the immigration EEA regulations 2006. What do they mean by that and what do I have to do now? How can i apply or provide evidence?

I provided them copies of my dutch passport. A bank statement of my aunty but now i can provide my own bank statement of 3 months. I give them 6 payslips but they say its poor quality. nowadays I have a job at another place since 9 weeks now. I have better payslips.
Thereby I also provided them my marriage certificate.
