Hi

My wife's spouse visa is due to run out in April 2011 when do we make our appliction for ILR? As I have just read the following on the Form Set M 11/2010 version guide

"You and any children under 18 who are applying with you should apply before the end of your/their permitted stay in the UK when you are nearing completion of the 2-year qualifying period required by the Immigration Rules.

Please do not apply more than 28 days before com-pleting that period. If you apply earlier than that, your application may be refused. If that happens, we will not refund the fee and you will have to pay again when
reapplying."

So do we send the application now or sometime mid April as the end of April?

Any advice would be helpful

Wife Arrived Feb 2009 Kids arrived July 2010 kids visa was set to expire the same as my wifes April 2011

Wife and kids may apply for ILR no sooner than 28 days prior to the 2nd anniversary of her initial entry in the UK on her spouse visa and before her visa expires. KOL required for wife.

Hi Yes my wife already has already passed her life in the UK test she completed this about 8 weeks ago she was told that the certificate would be passed onto the home office she was given a simple typed up sheet.

So going back to my question is it no later than 28 days before April 1st or is it no later than the 28 days before April 30th? Since the the Visa expires April 2011

Sorry for being stupid here and if i'm reading correctly you are saying that we should have applied in Feb as this would have been the 2nd year anniversary.

Are we going to have problems?

the earliest you could have applied was 28 days before the 2nd anniversary. She can apply any time after this but should apply before her leave expires otherwise if the application is refused she will not get a right of appeal.

Ok thanks that makes me feel better so i guess that means we have up to the end of April to get this done or do we send everything on the 1st of April?

I know this sounds like it is going round in circles but i just want to ensure I get this right i have had one bad experience when my wife applied for the spouce visa and the ECO Interpreting wrongly my financial status last time this is a lot of money i am going to be spending my wife and 3 girls and i don't want to mess up.

I think i'm just going to go for the 1st of April i feel safer with this date.

If the visa expires on 30th Aprilfor example then you should apply by that date at the latest but obviously you may wish to apply a bit earlier for peace of mind.

Note date of application if applying by post is date of posting.

Ok I have just come accross UK Border agency Fees From April 2011 to be increased from the 6th April 2011 i suppose this is a major increase in fees for dependents

I think i'm going to have send everythning asap to ensure we don't get caught by the old sorry you have sent the wrong amount so your application is invalid and you lose your payment.

Can i hand deliver the application form to what ever office or will this be rejected

if you send it by post then then the application is made on the date you post it. As long as you send it before the fees change you should be fine.

So If i send the application say on 25th of March recorded delivery it should arrive on the 28th of March I would be safe
