Time spent on outstanding application

Post by way2cool » Tue Mar 08, 2011 4:22 pm

Does the time spent waiting on outstanding visa application count in line with time spent in relevant visa category?

if you are applying under 14 year ILR, it won't matter. As long as you were in UK phsyically.

Make sure your "clock" didnt stop though.

It is there. Please look at "2.2.3 Events that break continuous residence"

From your previous post, you say you are waiting for a decision. You should wait for that outcome. You can't change much now...

yes im waiting on decision for reconsideration. Its was as a matter of curiosity nothing else as if i qualify for 10 yr rule for physically being here then its only couple of yrs due as I have spent over 7 yrs including time waiting for o/s application.

for 10 years ILR - you must have spent the time in UK 100% legally and with no gaps between visas.
for 14 years ILR - only your physical presence in UK matters. so you can spend time without a visa and still get ILR.
