Tier 2 VisaValid + Tier 1 Refused

Hi,

I am on Tier 2 (ICT) Valid till Aug 2011.I have applied for Tier 1 in Nov 2010,which got rejected.

I travelled outside of UK (as my Tier 2 was still valid) and on the way back Immigration guys have asked me,if my any of my VISA's was ever rejected and I have replied my recent application for Tier 1 has been refused.

The immigration officer left me and has spend around 10 min discussion the situation with her manager and whn she came back,I asked her if there was any problem and she said as I have aplied for Tier 1 my intention is to stay in UK permanently and she just made sure that I would have to leave after my current Work Permit Expires.

Next year when I go for Tier 2 Extension would the application be refused because of the above.

Any advice would be highly appreciated.

No.

But, whenever you apply for leave again (from within UK or outside) in future, don't forget to mention the refusal if the form asks "if you have ever been refused a visa".

Thanks for the reply sushdmehta.So the chances of my Tier 2 extension are bright.That helps.

Do you mean when ever I apply for ILR, I need to make sure to mention the refusal.Please advice.

I am sure this is treated differently to Tier 2 general, so it might well be that you wont be able to extend this one.

Tier 2 Intra Company Tranfer (Employer Sponsored Visa).

Note the use of "might" in the response above yours. Means the poster is not sure of what he/she is stating.

You should not have problem in extending Tier 2 (ICT) leave if your employer provides you with a CoS. According to the statement of intent published recently, the new rules coming into effect from 06-Apr-11 will not be imposed on current Tier 2 (ICT) migrants (see page 9).
