14 YEARS LONG RESIDENCY

I have been this country as part of legally and more as overstayer for about 12 years now. Can I make Long Residency before 14 years?

In old version of long residence concession of HO, there was a phrase hinting an application can be done between 10 and 14 years. Whilst I am now in 12 years, and if Home Office rejects my premature application straight, in tandem, can all my appeal rights be vanished too?

I think you should wait until the actual 14 years.

Topic, I also think you should wait until you have been in the UK for 14 years.

By the way it is no longer a concession. The Long Residence possibilities of getting ILR are now in the Immigration Rules.

Premature Long Residency Application

Thank you for ur advise. I have another critical question:

After 14 years, the process of my Long Residence application will take possibly a year. By early long residence application, can I take the advantage simply to fill 14 years during this period? In other words, could Home Office consideration be counted as part of fulfilment of my 14 years residency? Due to my desperate circumstances, I am pushing for acceleration at this stage.

Don`t take the risk wait for the 14 years, better to be safe than sorry.

If you apply prematurely your 14 year clock stops :evil:

so dont even think about it

Have you ever been serve a deportation letter? This is very crucial.

You need to find out before making such application. Remember HO can issued you this notice at your last known address.

Thanks for all ur responses. If I make a premature application for 14 years residency, HO rejects legitimacy of the application, can they remove me direct from the country? Or possibly asks me to wait for another 2 years to fulfill the 14 year period of time?

I can't see them agreeing for you to stay here illegally just so you qualify under the 14 year rules. Even solicitors will "officially" advise you to leave the country now. Off the record your lawyer will likely suggest you wait two years (as other posters here have suggested)

You can use the intervening two years to speak to solicitors, get your application paperwork together etc.

Will they pick you up and ship you off now? They certainly can, but they may not bother. Unless they're trying to pick up some easy targets to get some headlines in the papers.

Wait till you've got to year 14 - the consequences of a refusal are not worth the slim possibility of approval by applying prematurely.
