visa for my 5 months old daughter

visa for my 5 months old daughter

Hi,

I am not sure if this is the right section for my query but since it's related to ILR, I am posting here.

I currently have Tier1 visa which is valid until 2012. I will be due for my ILR application in September 2011. My daughter who is 5 months old, born in UK has just got Indian passport. Do I have to get her Tier 1 Dependent visa stamped before applying for ILR or can I apply for ILR directly. Also given that I am not planning to travel outside UK between now and my ILR application.

I am sure this would have been a query by quite a few people, can anybody share their experience or guide me whether I need to get her Tier 1 dependent visa specially given the newly proposed rules for ILR.

Mods, any help with this query will be really appreciated.

as you are not going anywhere before your ILR then you don't need to apply visa for her as PBS (Tier 1 Gen.) dependent. (Save u £500)

Also you don't need to include you daughter in your ILR application in Sep. 11 as once you get ILR she will be eligible for british nationality and you can direct apply for her british passport.

But if you dont intend to apply for british nationality after you ILR and also if you don't want for your duaghter as well then you must include you daughter as you dependent in your ILR application

Also, by any chance, is there an official reference to this so that I can provide that context when I apply for ILR or British passport for my daughter.

The baby will not be British. You can apply for a Tier 1 dependent visa when she is born.

Hi Victoria,

can you add little bit more about baby's status once Mr. Srujan get ILR in future. At that time should he register baby as a british citizen (direct from Tier1 depended to british citizen) or he will have to first apply ILR for her as well along with him and his wife and then wait for an other year for british citizenship.

Once one of the baby's parents is granted ILR you can apply for registration as British immediately. There is no need to apply for ILR for the baby first.
