With the grace of almighty ALLAH I have got my Tier1 G AFTER NEARLY 3 YEARS of ups and down with Home office.My details are as fellow.
Sep 2008:Applied Tier1Gen(in country) from IGS(refused under paragraph 321 (deception) with no right to appeal because my previous earning were not verified from my previous employer back home.No right of appeal given due to I still had LTR under IGS.
April 2009: Wrote to UKBA and asked for reconsideration of their decision.
Again refused by saying there is no admin review for in country refusals.
May 2009 :I took another chance and apply for PSW. it was also refused by saying your previous Tier1 G application was refused under para 321 so this application is also refused.
Right of appeal given this time.
Went myself in court and won my appeal by proving that my earnings/documents were genuine in my last Tier1 G application and there was only an error.
Dec 2009: Got PSW for 12 months.
I was not happy at all because it was Tier1 G I wanted and applied in the first instance.And now home office accepted their mistake in my PSW appeal and grant me the visa. So
Feb 2010: Wrote a letter to UKBA in which I asked them to review their previous Tier 1 G decision also in light of my PSW appeal success.
No reply at all for 2 months.
April:I sent first pre action protocol by saying if I am not in receipt of their reply in 14 days than I will take this matter in high court.
Received reply in 2 weeks in which UKBA agree to reconsider the 18 month old decision.
Than again no reply for 6 months.
Sep 2010: I sent second pre action protocol and gave them 7 days to reply.
Received their reply in 1 week by saying that they will give their final decision next week.
Amazingly again refused by saying that you had used deception in your Tier 1 G application and curtailed my remaining PSW.
Fortunately Right of appeal given this time also and my appeal was allowed in just 1 minute.
And finally now today I got my Tier1G visa until 2014 under the rules in placed when I first applies in Sep2008.
Its a true miracle of almighty ALLAH for me.Which I am and will be very thankful.
