EEA FAMILY PERMIT EXPIRING

Hi all,
My EEA Family permit is about to expire, and i have not applied for EEA2 as my spouse has not found work yet. i returned to The Uk through Surinder Singh my wife is british.

My question: if i apply for residence card using EEA2 form when my EEA family permit has expired would this affect the application.

The expiry itself is irrelevant. The question is whether the UKBA would accept that your wife is not economically active, but they should as I believe. Search the forum for 'Eind' which is the case that is actually relevant here.
