ILR for wife - some advice plz

ILR for wife - some advice plz

Hi,

I am concerned about my wife getting an ILR. Can you plz advise based on the following:

1. I am a British Citizen born & resident in UK, having own property, got married in Dec 2003 to Indian Citizen on a student visa to UK, who came to UK in Sept 2003 on 1 year student visa.

2. Wife granted spouse visa on 24th Aug 2004 for 2 years, which expires on 26th Aug 2006.

3. Wife is now going to apply for ILR in 1st week of August 2006.

4. Marriage is existing, we have all the documents as required by HO (I think!)

5. I am not in employment, but in full time education, just about finished my Master's with the strong possibility of starting my Doctorate Programme in Public Health Medicine. I was in employment till June 2005, but then decided to do a full-time Masters in Public Health Medicine, followed by a possible Doctorate. So technically I am still a student, earning £60 per week (as my course is full time!).

6. I had to resign from my last job to go onto this course (the last employer was not willing to give me a year off as I had decided to get a change in my career).

7. Wife is in full time employment (salary £ 1800 per month) as Health Development Manager, in Public Health and is also a clinician. Our joint savings (in terms of bank balances) touches £ 50,000 at present. We save about £ 400 each month.

THE CONCERN:

Will HO reject her ILR application as I am a full-time student & not in employment?

Will the HO ask for documents relating to my employment situation?

Will the HO reject her ILR application on the basis that we may have to recourse to public funds as I am not in employment ? (although we have in our joint account about £ 50,000)

Although I am looking for a job, the way things are at present with the NHS/UK health services, and as my studies are still ongoing, I do not see myself getting a suitable employment before August 26th (the deadline!)

Me & my wife are both very concerned and a critical reply would be assuring.

Come on, based upon what you say, and assuming the evidence of the two of you living together is solid, you will have absolutely no problem with this application.

There is no requirement for you to be working. There is a requirement to show that the applicant will not need to claim certain Public Funds ... that test easily passed here ... based upon what you post.
