what does this mean. Currently what is your visa status, is it dependant of a WP holder. If so then you can apply if main applicant is also completing 5 years at the same time as you,.

Post by oxyrich » Tue Apr 05, 2011 1:43 am

Hi,

my mistake i know it was'nt clear i'll try to be in brief.
when i was on my HSMP visa my spouse was on dependant HSMP for 2 years and after that my spouse company sponsored him 3 years of work permit and now im on dependant WP visa for 3 years, so my question is after completing 5 years i.e (2yrs of HSMP + 3 Yrs of WP Dependant) OR (2 yrs of HSMP dependant and 3 yrs of WP) can anyone of us is eligible for ILR?

Thankyou!!

Time lived in UK on dependant status cannot be included in qualifying residential period when applying for settlement as an economic migrant.

You are not eligible for settlement until such time that your Tier 2 migrant spouse becomes eligible to apply (for settlement). And, under current rules, your spouse must spend 5 years in the UK as an economic migrant to qualify for settlement.

Question: do i qualify for ILR? (does my TWES count towards my 5 year target?) or do i apply aggain for extension for a year then apply for ILR?

You may qualify for settlement after you have lived 5 years in the UK under HSMP+Tier 1 (General).
