Tier 4 extension refused plz advice

I have applied for extension on 25th of feb 2011 and i got my refusel letter on 7 april 2011.....but on the refusal letter date is 14 march 2011 there was a mistake by royal mail....i have given right to appeal....they refused me on the basis of funds....i showed my brother as my sponser but they r saying they dont accept anyother family member as a legal guardian......i have appealed saying i can proof my brother is only my legal guardian.....what chances do u advice my appeal will be succesfull plzz advice.....and am i legal in uk during my appeal in progress....thank you

Thankz for da reply....my dad passed away few yearz back and my mom is a house wife.....yes i can get da document to proof my brother is my legal guardian.....do u know how long will it take for hearing and will my status will be legal in uk till the hearing ?????

You have legal right to remain in the UK (by virtue of section 3C) until all appeal options are exhausted.

thank u.....i have appeal on my own beacuse i know i can provide them documents to proof my brother is my legal guardian and i am not going through any solicitor.....will deze matter ?????

Who presents the case ... you, on your own or through a solicitor ... doesn't matter. What matters is the evidence(s) to prove that the decision by UKBA was wrong.

note that you need to appeal within 10 working days of receipt of the refusal letter. If it was sent by recorded delivery you should print out a copy of the proof of delivery from the royal mail website in case UKBA dispute the appeal deadline given the delay in the date of the letter and the date you received it.

Also make sure you keep the envelope the letter was sent in. What is the date stamp on the envelope?

With my appeal I have fax them the envolep photo copy also by royal mail date on that is 04-04-2011 and i have orignal envopled with me in case they ask in future for more evidence.....i have send them a covering letter and my appeal form with the home office refusal letter....when can i send them more document to support my application r they going to ask for it ????.......thank u

thankz for ur replys highly appriciated......in my case i was suppose to maintian £3000 for 28 days i did only £1500....rest of the money i was depending on my sponser who is my brother......now during my appeal what if i maintain fresh £3000 in my own account for another 28 days will that going to work ???? plz

1. No, the funds need to be for the same period as u provided initially.
2. As long as you u can prove that your brother is your legal guardian then you will win the appeal.
3. The documents need to be the same format as suggested by the Tier 4 guidence.

thanz for ur reply.....how long will it take roughly for the hearing in my case as i have 1 of my friend whose appeal took him almost 14months for the decision.

The appeal is usually listed about 4 weeks after you lodge it but it depends on how busy the tribunal is.

You will the usually get the decision of the tribunal within 4 weeks of the hearing. I would imagine your friends case took 14 months because there were subsequent appeals or adjournments.
