Tier1 General - Querry by refusal Officer :Help required

Post by ravikrish1980 » Sun Apr 10, 2011 7:57 pm

Hi,

I applied for tier1 General same day service at PEO. In the past I have spent £2000 behalf of my company which they paid me back while they transfer my net wages of £1500. But my employer hasn't transfed as two seperate transactions. They transferd to me straight £3500.Eventhough i havn't claimed points for that £2000 which is not my income, refusal officer sent me letter with querry that they need explanantion in 7 days from employer for the reasons of why £2000 is outstanding to me and they need evidence that tax has been paid for that. I am not sure what to do now. If they dont consider my net wages of that particular transaction my application will be declined. Can somebody advice me please.Eagerly waiting for your reply.

If the money has not been paid to you, then how can it be included in "earned income". You are yet to earn that amount of money (yet to be paid to you).

Hi,

Thanks for your quick reply. It looks like I havn't explained properly.

My Net wages according to Payslip is : £1500

Money transferd to my bank account from employer is : £3500 (£1500 of net wages + £2000 of money I spent for them in tha past behalf them)

I have claimed points for only my net wages. But because of it is a single transaction, Refusal officer is asking for

a) Explanation from employer that of reasons for £2000 that is outstanding to me from them

b) Evidence of paying tax for that £2000.

Employer is ready to help with whatever i need. But i am bit worried that if i take a letter from employer that i spent £2000 for thier expenses and it is reimburssed, i am not sure whether officer will be satisfied with that. Please do give me your valuable suggestion as this visa is very very imortant for me and as Tier1 is closed now it is not even possible to make new application. Please help me.

This seems pretty straightforward.

Just get a letter from your employer stating:

On (date) he was paid a total of £3500. £1500 of this amount represents his net salary (as per payslip (date)), the remaining £2000 was a reimbursement for expenses.

Then you write a letter stating:
Out of the £3500 paid, I am only claiming for the £1500 representing my net income (as per payslip (date)).

I think NAFE12 is correct. And pls don't confuse people by saying "REFUSAL OFFICER", which u already done to many of us I would imagine. Anywayz, u can do exactly what nafe said & also been endorsed by seniors. U should be fine.
