ILR section 9 about scoring points?

Post by asdf786 » Thu Apr 07, 2011 11:48 am

Hi,

Its still long time to apply but could any one advise if i need to fill section 9 for ILR in following situation;

First entered as: HSMP (22 April 2008 to 22 April 2010)
Extension: Tier 1 General (9 april 2010 to 9 April 2013)

Will i apply under Tier 1 General Category or Under HSMP category?

thanks

Qurban

HSMP plus Tier1

Does section 9 count for initial HSMP? I do not have recent continuous 12months. It's not fair.

How does anyone else see this?

That would be your HSMP date. Could you let me know if this is your Application for HSMP Letter or HSMP Visa date?

Does that mean that if I have entered in the UK under HSMP then extending to TIER 1, now i will be treated as Highly Skilled Migrant under "SECTION 3" page 7 of the form for applying ILR?

thanks,

Any HSMP migrant who applied for initial HSMP approval on/after 07-Nov-06 and has current leave as Tier 1 (General) migrant needs to apply for settlement as a Tier 1 (General) migrant - irrespective of whether the initial (first) grant of leave was as an HSMP migrant or as a Tier 1 (General) migrant.

Fill up the form accordingly.

You don't have to claim for all 12 months as long as you meet income criteria.

Except the age which you will claim for the initial application (i.e. HSMP). That begs the question. Is it HSMP Letter or HSMP VISA? Not sure. I got mix replies from people.
