Hi

Anyone can help me to understand the new rules for ILR please.

I was granted HSMP in Jan-2009 then extend my HSMP under Tier-1 (General) for 3 year. I would complete my 5 years in Jan 2013.

1. Do i need points (75 or 80) for ILR
2. if yes then What is the points critaria (Qualification, age, earning etc.)

One of your dates is off. 2009 to 2013 is 4 years. Did you get it in 2008 or is the 5 years up in 2014?

Yes, my initial HSMP was granted on Jan-2008

Yes, as of very recent rules, you need to score 75 points. Points criteria is exactly same as you have done for your extension.

These new rule implemented in April 2011.

They bring new changes everyday. Do not know what will happen in next 2 years.

It’s so bad...honestly, it sucks... for ILR we need points again.... :shock: Well

I don’t think that rules will be changed next few years(at least in this Govt. tenure)...because these are radical changes/extreme changes in immigration laws...may be little tweaks could happen, bits and pieces can change but not major changes like “Earned Citizenshipâ€

According to my understanding as mentioned in the guideline (in the link above), Age points will be awarded according to rules of first application (not the last one which was extension).

Those rules were:

Under 28 years of age = 20
28 or 29 years of age = 10
30 or 31 years of age = 5

So on the date of your first application if your age was under 28, you will be awarded 20 points (though you will be of age 33 at the time of ILR application).
