situation: i'm on a dependent HSMP visa
working full time etc
am planning to get separated
I have my visa extended for 4 years
will i lose my visa if i separate
& how will they know that we've separated?

You were given the visa on the basis of your relationship with your husband, if that relationship break down your visa is no longer valid. They won't know about it unless you tell them, but if you want to get ILR you will probably be best off to obtain your own permission.

Worst scenario - your husband can write to the HO and tell them that you both have separated / divorced.

if i get my work permit done, will the years on the HSMP dependent count towards PR?

I think - may not.

Dependants get ILR based on original work permit/HSMP holder. You may ask them to consider this period based on your own NI and ITax contribution but I am not sure.

If you get your own work permit, your clock start from that moment.

However, your stay before break-up will count if you were to apply for ILR based on 14 yrs stay.

interesting , how all of you automatically assumed that the person who posted the query was a woman ...from the words "dependant visa" ..MCP anyone ? lol :lol:

It wasnt assumption rather reality because subject says that "will i lose my HSMP dependent visa if i separate frm hubby".

yes, vidya, they can prolly sponsor me, but I lose the 3 years that i stayed here & the clock for PR gets reset to zero. it's so damned unfair.

I wouln't think that your clock will be reset; check the documentation and ask an advisor. From what I have read, you held a visa conducing to settlement for the past 3 years, then getting a WP or HSMP yourself will be another visa conducing to settlement....once you are applying for ILR you need to prove that you have held it for 5 years. (I know you are a dependant, but I haven't seen that difference made on the visas, the documentations or the applications)...would be worth to check..

Even though your employer is willing to sponsor a WP , the current immigration rules donot allow a dependant to switch to WP. So, in any case the clock for the PR has to be reset as you will have to leave the country before switching from Dependant to WP.
