Is Paternity Leave a public fund (£108.85 for a week)?

I am here in UK on HSMP visa from the last 2 years.

I am eligible to take up to 2 weeks - 3 days at your basic rate of pay with the remainder, should you choose to take it, paid at the statutory rate of £108.85 per week.

I am eligible to take £108.85 for a week or should take the unpaid leaves?

The Paternity pay is not Public Funds, as defined, for two reasons :-
  • it is not included in the definition of Public Funds in para 6 of the Immigration Rules
  • it is paid to you by your employer, not the Government
So totally OK for you to get that £108.85 per week amount.
