9 months gap due to illness

Post by gnfonline » Thu Apr 28, 2011 8:57 pm

A friend of mine has been in the UK for over 10 years. Over the last 10 years, the total days of absence from the UK are less than 18 months. However, she got very sick while she was on holiday at her own country, and had to stay there for 9 months to recover.

Has she got any chance of getting the ILR based on the 10 year rule? Has anyone here heard of any successful cases under similar circumstances?

Many thanks for any reply

1. According to the rules no chance.
2. Speaking to a good solicitor will clarify things in more details.
3. Doctor's letters, medical bills etc will help to argue the case for 3 months.
