ILR for Dependent

Hi,

I am due for ILR in end of June 2011 via the WP - HSMP - Tier1 General route. I got married in Nov 2010 and my wife came to UK on 10th Dec 2010.

By any chance can I apply for Her ILR along with mine in June this year as she will complete only 6 - 7 months till then ?
If not then which visa will i have to apply for her ? and how soon do i need to change her visa status ?
What all documents do i need to provide for her visa?

Hi Gaurav

To answer your first query, I believe the answer is 'no'.

Don't think your wife can apply for her settlement with just 6.-7 months of cohabitation document / proof.

I think for her, you will have to apply as a dependent

Gaurav,

When did you get your HSMP? If covered by JR, dependents status follows the main applicant, hence your wife can get ILR at the same time as you.

This is tricky but worth trying if you fall under HSMP-JR document.

Hi,
Here are the dates :

1. Entered UK on a Business visa on 25th April 2006
2. Went back to India on 14th July 2006 and came back to UK on 19th July 2006 on a entry Clearance - Work Permit.
3. Changed this Work Permit to another organization while in UK on 15th May 2007.
4. Got a HSMP approval on 20th Dec 2007 within UK
5. Got the stamping done on the passport on 26th Feb 2008.
6. Renewed to Tier-1 general on 26th Feb 2010.

As per the dates above I am eligible to apply for ILR in end of June 2011 as per the first WP entry and 28 days rule..is that correct ?
I think HSMP-JR is valid for people who got approval before Nov 2006 ?

You are not covered by HSMP-JR document, hence your dependents will have to follow the standard rules

Gaurav,

To be precise, you should apply FLR(M) visa which is a dependant visa and it's valid for 2 years.. On completing 2 years, she can switch to ILR visa category. Hope this helps.

You can apply for FLR(M) as soon as you get the ILR, but there is no specific timelimit.. The maximum threshold will be when your wife visa will be expiring.
