Continuous Period question, will it reset ?

Post by dehjet » Tue May 10, 2011 9:13 pm

Hi experts, I have been issued an entry Clarence with HSMP on 23/05/2007 and I entered to UK for the first time on 15/07/2007 (less then 2 months after) when I had a few job interviews in the UK and returned back to my country in a few days after. (on 18/07/2007).I received a job offer while I was in my country and came back to UK and started to work as a full time employee on 25/09/2007 (aprx 2.5 months after I stayed in my country). Later years I have extended my HSMP visa with a Tier-1 visa on 23/05/2009 until 23/5/2012 when 5 years period will be completed.when can I apply for ILR ? what time will continuous period will start for my case ? Do I need to extend my stay first if I am not counted as eligable at the end of 5 years now ?

I have checked the forum and found a recent change to the rules: http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary

It is written that if time gap between entry clearance and the first entry to UK is less then 3 months , it will be counted towards 5 years continuous period in the UK , which is a good change. However, as i wrote above I have another 2.5 months absence for the period that I was not started for work. Will it reset my continuous period ?

Thanks.

Total no of days (out side uk) should be less than 180 days.

is the first 53 days gap (days between the visa granted and the first entry to the uk 23/05/07 to 15/07/07 ) which i took the advantage of the recent changes (about up to 3 months extension if the first entry is delayed) will count towards this limit ?
