tier2 to tier1 application outside UK

Post by tier1toTier2 » Fri Jul 09, 2010 2:13 pm

Hi everyone,
I have a valid Tier1 upto 2012, currently i m outside UK and have previously traveled to UK thrice on short terms.. now i have a opportunity to go to UK on Tier2.

I fulfill the Tier2 criteria very much,my question is

1. Is there a chance that the home office reject my application based on my tier1 visits to UK.
2. please confirm that tier2 will override tier1 visa, which i m sure.
3. If my tier2 gets rejected will my tier1 still be valid

1. No.
2. If Tier 1 was applied from outside (i.e.- EC), then no.
3. Yes.

ECB10.5 Applying for another visa but in a different category wrote: An applicant may hold more than one valid entry clearance, for example a regular traveller already holding a longer period multiple visit visa can be issued with a visa for another purpose. When issuing a second visa, the applicant should be advised to explain to the Immigration Officer on arrival in which capacity he/she is seeking entry to the UK.
This was published on the UKVisas website until last month but it seems it has been taken off.

ECB10.5 (quote above) has been replaced with this new instruction:
Can I have more than one visa? wrote:It is not possible to hold more than one visa or entry clearance. If your circumstances change you should always inform the Home Office before you leave the UK so that your permission to stay can be curtailed. Once your permission to stay has been curtailed you will be able to apply for a new visa overseas.

If you mean Tier 1 (General) when you say Tier 1, please be advised that Tier 1 (General) immigration category is now closed (for new applicants).

So, does that mean I cannot apply for Tier 1 whole of this year?

No you cannot. For all intents and purposes, Tier 1 (General) is now dead and is only open for people wanting to extend their existing Tier 1 (General) visas. So unless you have a Tier 1 (General) visa, you cannot get one anymore.
