Spain - expiring in 6 months regimen communtario

Hi!

Any help will be greatly appreciated.

I am an Australian married to a French woman.

I am living in Spain.

I have a French Titre de Sejour, that expires in August 2014

I also have a Regimen Communtario for Spain that expires in November this year.

I have been in Spain since October 2004.

I would like to stay in Spain permanently and be legal.

What advice does anyone have??

Can you not just get a tarjeta de residencia?

I believe you have to have been living in Spain for 10 years in order to apply for a Spanish passport. You can get permanent residency though because you have been living in Spain for 5 years. Then in 2014 you could apply for nationality?

When your 5 years Regimen Communtario expired or 6 months before expired, you can apply you for 10 years permanente and thereafter if you can demonstrate the understanding and knowledge of Spanish Language, then you are on the track to obtain the Spanish passport.

So to clarify, I am entitled to a new 10 year visa.

Would either of you be able point me in the direction of a website for this to find when I can apply, what documents I will need and how long the process usually takes.

You can then decide which form you need of all these and you will then need to go to the oficina de extranjeros or the comisaria where you are empadronado. No idea how long it takes, sorry. As a British citizen I simply have the piece of paper for people from EU to live and work here which was given on the spot, don't think yours will be though.

I went today the office in Paseo Sant Joan, here in Barcelona.

For the possible future benefit of someone in my position I will provide the details of what I found out today.

They gave me the following link to make an appointment:

And also this link to a form which I need to complete:

Also I need to bring the following:

a) My current Regimen Comunitario
b) My passport (Australian)
c) My marriage certificate issued no more than 3 months prior to renewal application and officially translated.
d) My wife´s passport or national identity card.
e) Three recent colour passport size photographs (on a white background)
f) Proof of payment of the fee for issuing the card (Bank-stamped Modelo 790)

and the earlier mentioned application form.

Then appear at the organised appointment, provide the above mentioned documents and then wait for a (hopefully) positive answer within 3 months.

Sounds pretty straightforward, I do not see any problems with you being given the residencia especially as a family member of an EU citizen... To be honest I am glad I can avoid...Last time I went to the oficina de extranjeros they just treated everyone like crap.
