ILR without employer letter? Urgent help required

ILR without employer letter? Urgent help required

Need to help someone. He has completed 4 years of proper employment in UK , current is a good job, has all the papers except employer letter. Is there a way he can get the PR?

Just go to HR (bypass line manager) and ask for it - say its for morgage application, they cant deny this request and they can't fire for that - in either case any potential issues will come after ILR application.

It may be helpful to know why you are unable to get an employers letter?

The employer has a policy that they do not issue this letter to anyone. It has nothing to do with individual employee
All other papers are in order.

Exactly what do they not issue - a letter in support of ILR or a letter confirming you work there? Surely its fact that you are an employee? Am lost - its not like you are asking for a reference letter. Do you work for an umbrella type set up?

They do not issue a letter in support for ILR. They do say that you are am employee but do not say that they want you to continue to work here, the line that is required to get ILR

they have to just write that the employment is continuing nothing else
something like this

To whomsoever it may concern
This is to certify that Mr/Ms XX is working in our company as a permanent employee since xx/xx/xxxx and the employment is continuing

You have a very strange employer ! I feel its high time you teach them the importance of communication and written correspondence !

Just one :idea:

If you ask them to give you a salary certificate, they will have to write something like " your current salary is £x ".
Don't you think the above wording will convey to the outside world that your are continuing employment with them ????
So, I wont be surprised if they issue you a letter in Greek !!

I am pretty sure their refusal to provide statement that you are employed is illegal. In fact it sounds like its best to leave that place of work as soon as you get ILR.

I suggest you use strong arms tactic and demand confirmation of you employment from HR. Take recent payslips and the fact of continueing employment can be easily proven.

If its one of the so-called "sweatshops" then do everyone a favour - report them to authorities as soon as you leave. This can be done anonimously.

yeah ATW ..your inferences could well be true !

or may be its the case that they are not paying tax and national insurance on anjalik's salary thereby employing him illegally ?

Fearing that they might get caught on this occasion - may be thats the reason they are refusing to give such a letter saying the word 'continuing employment'.

anjalik - do u get a proper payslip each month ? If you do, make sure the employer pays tax and NI on behalf of you from your salary whilst you are employed. I think its high time you start bagging your documents otherwise homeoffice will make you pack your bags.
