Road to PR after 5 years on Tier2

Post by robbyuk » Thu May 19, 2011 10:22 pm

Hello friends...

Hope u can help me understand this...

I came to UK on Tier 2 (ICT) in early 2009 and have already undergone extension once and the next one is due next month. This extension would be for 1 year...

My question is if I continue staying in the UK after getting extended for 1 year each, would I be eligible to apply for PR when I complete 5 years in 2014?

Thanks in advance!
Robby

No one can tell you today what the rules may be in 2014.
For current requirements regarding settlement as a Tier 2 (ICT) migrant, see 245GF.

I know we can't tell anything right now, but on the Home Office webpage there is a statement mentioned -->

"If you applied under the Tier 2 (Intra company transfer) category before 6 April 2010, or if you switch into that category from being an intra-company transferee work permit holder, you may be able to apply for settlement when you have been here for some time"

Refer this page: http://www.ukba.homeoffice.gov.uk/worki ... tier2/ict/

I don't understand one thing here - I have been in the UK since 2009, so, I am eligible as per the rule mentioned above, however, I have got an extension after April 2010, hence, my doubt is whether I am still eligible?

There is a difference in the name of the visa. It was called intra-company transferee work permit. After the PBS was introduced the visa is now called Tier 2 (Intra company transfer).

All it is saying is if you came on Tier 2 (Intra company transfer) or intra-company transferee work permit before 6 April 2010 and then extended/switched into Tier 2 (Intra company transfer) later when you had to extend the visa, you can still apply for ILR.

going from intra-company transferee work permit to Tier 2 (Intra company transfer) is technically a "switch".

Many thanks for your reply, Joh...!

The only doubt I had was if I get extended for 1 year every time from now onwards, I would require 3 extensions and whether UK Home office will still consider my start date as prior to April 2010?
