Do I qualify?

Post by gtrivedi » Mon May 23, 2011 4:02 pm

Hi I'm having a hard time understanding if I properly quality or not.

here is everything...please someone who is experienced can they tell me if I qualify?

1. I was born on 29 july 1980 (so I will be 31 yo on 29 July)
2. I came to UK on 25th April 2005 (So I have finished 5 years last year actually...but didnt apply and procastinated)
3. I have been out of uk for less than 60 days total in last 6 years.
4. I donot have all my P60s but have an letter from HMRC telling my earning history from 2005-2010. I have the P60 for 2010-2011 which I recieved end of April 2011.
6. Going back last 12 months, I have been with company 1 since Nov2010 and before that I was another company 2.
7. My total salary for last 12 months (without deducting the tax) is £40200.

My visa history

1. April 2005- April 2006 (work permit)
2. April 2006- April 2007 (Work permit extention)
3. April 2007 - nov 2007 (work permit extention)
4. nov 2007 - nov 2009 (HSMP)
5. Nov 2009 - nov 2012 (Tier-1 General)

and I finished 5 years in UK on April 25, 2010.

The problem I'm having is when i see section 9 on Set(o) form, I dont know how much points I will score under earnings and degree. They have this statement which I dnot understand.

"Applications for indefinite leave to remain where an applicant has had leave as a Writer, Composer or Artist, Self-employed lawyer, or as a Tier 1 (General) Migrant under the Rules in place before 6 April 2010"

I dont know what this really means?

Please can someone point me on the right direction. making it points based means that some people may not qualify now who were relying only on 5 years lawful residence???

This is not fair. atleast for people who have paid their taxes.

You need 75 points to qualify for settlement. Refer to Table 2 given in the Tier 1 settlement guidance.
