ILR Application

Hi All,

I just need to check when can I apply for my ILR.

Following are visa's I had since I came to UK

10 Oct 2004 - 31 Jan 2008 (Student Visa)
1 Feb 2008 - 20 May 2008 (IGS visa)
21 May 2008 - 20 May 2011 (Tier 1 General Migrant)
21 May 2011 - 20 May 2013 (Tier 1 General Migrant Extension)

I have read the rules of ILR but I'm slightly confused.

Could someone please help me on the same?

This has been answered countless times on the forum. Your ILR qualification period starts from 21 May 2008 and add 5 years to that for your ILR qualifying date (as per current rules)

I also want to mention one thing that I was in India for 180 days as I had an accident (18 Aug 2008 - 10 Feb 2009).

I have got Medical Certificate to confirm the same.

Will it affect my application.

I think 5years counting will start from following date as IGS period not countable for settlement.

21 May 2008 - 20 May 2011 (Tier 1 General Migrant)
21 May 2011 - 20 May 2013 (Tier 1 General Migrant Extension)

Being away for 'exactly' 180days on one trip can ring some bells IMO. It is rather too much of a coincidence that the time you spent away matches your total absence limit and hence seems to give an indication of your control over your holiday/accident recovery with your ILR application in mind.

Such issues i guess are dealt with on a case by case basis. SO if you are lucky you will get your ILR on 21 May 2013 or a worst 10 Feb 2014!!
