When will I eligible for ILR

Post by flytouknida » Thu May 26, 2011 11:06 pm

Hi All,
I have tier1 visa until 10-Feb-2012. I came UK on 8-Mar-2007 on HSMP. As I read, I can apply for ILR one month before finishing 5 years.

In that case, I am eligible to apply for ILR on 9th FEB 2012. It looks to me bit risky to wait until last couple of days.

My friend told me that I am not eligible for ILR, as I don't have complete 5 years visa. As I came 28 days after my visa, so I have valid visa 28 days less than 5 years. so I am not eligle. I have to go for extension.

Can someone advise me? ...

Regards,
Nida

I agree with that, you can apply for ILR on 09.02.12, but risky? Just make absolutely sure that ALL the required evidence is submitted with the application.

Have you seen any one applied one month earlier for ILR?

Thanks

I thought there is a 90 days exempt from the date the Leave is granted and the person enters the country. Is that not true.

Please see the link below for more clarification.

We can count the initial time gap if it is less than 90 days.
