Wife is getting lone parent benefits and naturalization

Hi,

Bit of a complicated question here out of interest for a friends situation.


He submitted his application in feb 09 and stated married, she sent her application in april 09 and stated separated. She has been claiming benefits as a single parent since may 08 and still is. Their relationship was breaking down, but he still lived in the house and worked away. He still sent money home and took care of his business. He never knew about the benefits she was getting until last week. She claimed abandonment, but he never abandoned them, it was agreed he work away. Or he thought it was....

She called the police and said he shud not get his garda card renewed as he had left ireland, but he had not, he just worked in another town. He did get it renewed after he proved he was in ireland. He has now changed his address as he has moved out of the house finally after the marriage is definitely over. He informed the INIS of his address change but not why.

Now with this in mind, she claiming separated, him saying married and the benefits she claims and the fact he is waiting on his citizenship, how will this affect his application?

He is worried as his garda expires in July.

I guess they have different perceptions of the state of their marriage. They could have been separated between Feb and Apr so I dont think that should be a problem. The wife's claims of benefits will be a minus for the wife but if the husband can prove he is working and able to support himself he should be ok. Hopefully there is no criminal record i.e. wife has not claimed domestic violence? 'Cos it seems their relationship is far from cordial and wifey will do anything to get estranged hubby in a bit of trouble...
...though it tarries, it shall surely come...

I don't think this will affect his application. He is still legally married, so he didn't lie on his form. She will be the one in trouble, especially if the Dept finds out she has been defrauding the social welfare system!! :o

This is really good news for him.

She did report domestic violence in 2010, this he found out when he was trying to renew his garda card, but he was not at the house the day it happened. He was in the UK on a business trip! He explained this and was advised by police to get a formal separation. So he has started the process now.

He has been working since he arrived 10 yrs ago and has not even claimed sick benefits ever. She has been getting lone parent since may 08.
And thats i guess when she considers them done, although he still lived in the house, but never told him of the money she was getting. Just scared this would look like they were ripping off the system, when in deed he had no idea!!
She had no formal separation agreement, she just put separated on the form. If she put married im sure its gonna look worse as she was in receipt of benefits when she sent her application. And she still is getting benefits....

Just hope none of this will affect him.
