Another 10 days Visa required to be eligible for ILR


Hi Guys

Please help me on this one

I got my HSMP Stamped on the 16 May 2007, and arrived in the UK 26 June 2007. (my initial Visa was valid until 16 May 2009). applied for extension in May 2009 and was granted 3 years Visa which is now valid until 16 May 2012

The confusion that i have now is:

When i initially applied for my HSMP i was under 27 - so was granted full points for age - same was the case when I applied for my first extensio i-e under 29 and was awarded full points for age.

Now that I have to apply again in May 2012 for a further extension of 10 days to be eligible for ILR, My age will be 31

1/ Will I still get points for my Bachelors degree? as i get 30 points for BSc in my initiall application and then again got 30 points in my 1st Extension

2/ Will i still be getting full points for age? or is it 10 points for age now?

3/ Can I apply for an Extension now? I still have 1 year and 2 months Visa remaining on my passport. even if they cancel my current visa and grant me visa from the date of my 2nd extension application i will still get my 10 days covered and will still get full points for age.


Please Advise

You will be able to get multiple extensions according to the current rule, the best thing is you should check point calculator on Home Office website and see if you are scoring sufficient points.

you can apply for your ILR 28days before your visa expiry so u will be eligible right,..so y 2nd extension..

correct me if i am wrong...

since my visa was stamped on the 16 of may 2007 and i entered UK on the 26 June 2007 so i have used up my 28 days and now about 12 days short in applying for my ILR

my visa is now valid until 16 May 2012 and my 4 years and 11 months will complete on the 28 May 2012

Any suggestions please

Dear Sushdhtame,

I know it is soon to think of, But if this rule be approved by Parlimanet, do I need a second extension?

HSMP Visa date 14 May 2008
Arrival 15 Aug 2008
Extention to Tier 1 20 Nov 2009
Extension Valid till 14 May 2013

mah, you are over the 3 month limit, though by only 2 days. Unless you want to risk a refusal of your settlement application, you should apply for extension.

How long will the second extension be given ? will it be just 2 or 3 months so you can re-apply for ILR(ie just to cover you to 5 years in total) or for a year or so ?

Dear All,

I didn't get any reply to my previous post so I am asking it again with more details.

My timeline is as follows:
HSMP Visa date 14 May 2008
Arrival 15 Aug 2008
Extention to Tier 1 20 Nov 2009
Extension Valid till 14 May 2013

It seems I am 2 days short for ILR so I need to apply for 2nd extension in future. So my second extention will be in 2012 so I can apply for ILR in Aug 2013 (when my 5 years completed)
My question is (considering my application date for 2nd extension in 2012):
When I apply for ILR what category I fall into (The rules after or before April 2010)
Do I need 80 points or 75 points for ILR?
If 75, Am I considered under the rule in place before April 2010 or before March 2009

well, good topic, i might as well find out when I can apply for ILR.

initial HSMP approval for years. 5 Nov 2007 - 5 Nov 2009
Extension -- 28 October 2009 - 5 Nov 2012

If I am right, I should be able to apply for ILR in October 2012.

Sorry not to be smart enough. I read it again. But I am still confused. I don't understand which one I am. Still I don't know I need 75 or 80 and which table I should refer to Table 2 or Table 3.
