When you have had ILR for at least one year. Simple as that. No 28-day rule for citizenship applications.

Also make sure you were physically in the UK exactly 5 years before UKBA will receive your Naturalisation application.

Citizenship Application

Post by tulip4500 » Sun Jun 05, 2011 11:34 am

hi

i have a driving conviction LC20 which was disclosed on my ILR application which was submitted on 13 March 2011. and I was successful.

ILR given date is 5 April 2011.

now I like to apply for citizrnship on 5 April 2012. My LC20 offence date is 22 July 2007 but conviction Date is 10 October 2007 so when this offence will be spent? on July 2012 or October 2012 (5 Years after) I had a fine of 120 6 points and no Ban. MY points will come off next month (July 2011) from Licence.

now when can i apply for citizenship? April 2012? or October 2012? or July 2012?

I saw in guidance that if there is only single conviction and that is Minor then I can be successful in citizenship. so is LC20 is minor? please advise.

if they refuse me in Arpil 2012 then Can I apply again in October 2012? and i will have good chance of success? please advise.

LC20 is "Driving otherwise than in accordance with a licence". Exactly what did you do?

LC20 is not a minor offence. I presume this was driving on international licence without having a valid UK one after spending more than one year in the UK.
You will need to wait for 5 years after conviction - October 2012. Otherwise, most chances are that your application will get rejected. You can apply in April and if rejected (most likely) apply again in October but I suggest you save the £800 application fee for something else.
Search for LC20 in the forums if you want to compare you case to others.

LC20

I had a driving test and I went alone to attend the test. and The examinar failed me in the test and reported to police that a failed candidate is going home alone. and my house was in nottingham and test centre was in sttaford. and police found a route to nottingham and was hiding on a road side looking for my car to pass. and when i passed them they started following me for a mile and then flashed me to stop and then took a interview in police car and then they seized my car and left me alone on street. then i came home by bus and train. and after 2 months i saw a letter from court for hearing. i didnt attend hearing and i pleaded guilty by post. and i found out the court put 6 points on licence and £120 fine and no ban.

later i took a friend and paid £150 to release my car and he drove it back home. and now i passed the test later date and now i have a full licence.
i also paid the fine and court fee totaling about £200.

i was not charged for Insurance offence. as I had proper valid insurance.

Breaks should not be more than 90 days in total, it does not matter how you spend the breaks. You can either have a full chunk 90 days outside the UK or you can split the 90 days allowance how ever you wish.

So in a nutshell you basically have to stay just over 9 months in the final 12 months to be within the rules.
