Hi Team,

I have a small clarification on renewing my Tier 1 General Visa. If during the 12 month period that you are showing to claim your earnings can i include a month during which i have taken time off. Meaning out of the 15 months i am claiming my earnings for 12 months and in these 12 months, i was in UK for 11 months and 1 month in India on a holiday. I have 33 days of leave which i can make use off. So can i include this one month as well?

Hi

I assume if you have 12 months salary slip for UK , the case is simple.

Irrespective of your vacation , time off for a month or so. Salary slip fopr that month is good enough.

Guys,

I was reviewing the UKBA website Appendix A Attributes: UK Experience notes (please refer to this link: http://www.ukba.homeoffice.gov.uk/polic ... appendixa/ - 31. Previous earnings will not be taken into account for the purpose of awarding points for UK experience if the applicant was not physically present in the UK at the time those earnings were made.)

Here under the UK Experience notes: its mentioned that the points for UK Experience will not be awarded if i was not physically present in the UK during the time this earnings were made. So if i take 1 month vacation in the 12 months that i am claiming, will i not be awarded points for UK experience?

Or since i fall within 19th July 2010 rules, if i show greater than 25000 GBP earnings in the 11 out of 12 months that i am claiming, can i get the 5 points for UK experience.

Please clarify and indebted you for your help

That one month vacation was paid leave from your UK employment so yes it still accounts as earnings made in the UK, so you can still score points for UK experience.
