Appeal+fresh application at the same time for dependent visa

I had a query regarding dependent visa application.

Is it possible to apply for fresh dependent application when you have an appeal pending with ECO (local decision) for dependent visa refusal??

If your appeal is successful then can you withdraw your dependent application and in this case would you get a refund??

Yes. See APL1.20 Applicant makes fresh application while an appeal is outstanding.

but i dont think u will get a refund if u withdraw application..
u know ukba is after money...so
