Switching from Dependant to Work Permit visa

Hi,

I started work ona dependant work permit but my employer now wants me to shift to work permit. I want to know if i need to go back to home country to get visa stamping done. Could someone please throw light on this.

If the status of your partner or the person you are a dependant on leads to settlement then you are better of staying as a dependant, as soon as you change to a WP then you are basically locked into that company for X amount of years alternatively you should try and see if you qualify for an HSMP. Once you obtain either the WP or the HSMP, I suspect you would have to return to your home country to obtain leave to remain

Can you explain why are you letting your employer dictate to you what kind of visa you should have? If your partner or spouse is still on a valid work permit then you are prejudicing yourself by moving to a work permit as this will lock you into your employer. Besides which you will have to face the hassle of leaving the country in order to switch. Why not not just stick with your dependent visa and you can tell your employer to shove his work permit you-know-where. If he's not happy with that then just change jobs. That's the beauty of being on a dependent visa.

Sometimes people can be over enthusiastic in giving advice, a more polite way of explaining it would be that it would probably be in your best interest to stay a dependant especially if it leads to obtaining ILR or PR or residency

it depends on how long his spouse has held the WP for and it is helpful in the event his spouse looses her job

Yes very well observed olisun, however if you read very very carefully you will see I did say as long as it is leading to settlement, maybe it would be good as a back up plan but slightly flawed in terms of how long before he receives settlement as soon as he gets a WP he will start the clock all over again on his ILR route.

Vineela could you possible tell us what your partners status is right now, is it a student or a WP visa?

But no where has the OP mentioned how long he has held the dependant visa for... if it's only 6 months then I would switch to my own WP.. If it's more than 2 yrs and then I would look at my wife's job status and then decide...

(But would you wait even a day longer then you had to to get ILR?)
