can i apply for a British Nationality Before 6 Years?

Post by ashrafman » Tue May 24, 2011 1:56 pm

Hi There.

Thank you for your Help

I am from Lebanon
My wife from Poland
Got married in March 2007
Got 5 Years resident card till March 2012
My wife will get the British Nationality in July 2011 and her Country allow the Dual Nationality.

What is my situation after my wife will get the British Citizen?

Will I remain under the European Law or I will be converted to the British Law?

Will I get the British nationality faster when my wife becomes a British Citizen or I have to wait until I complete 6 Years to apply for a British Nationality?

Thanks

Once your wife gets British Citizenship, you will meet the following requirements in your case

No. PR is also a requirement.

But will his PR card still be valid after his wife becomes british in July 2011?
Or does he need to switch to spousal visa??

There is already an exception.

If wife is naturalised, then wife's exercising Free movement rights has already been established. I think that it could be argued that this is also an exception.

Thanks Vinny but the exception you noted relates to exercising treaty rights in an EU country prior to moving to the UK. While this can apply, this is not the exect situation here.

Shouldn't the OP confirm his rights with UKBA first instead of waiting until the time of PR?

Could anyone advise what conditions should be fulfilled when applying for BC as husband of dual British Citizen/EEA National?
Does the husband apply as married to British and provides only his wife passport and marriage certificate?

Dear Vinny
Thank you for your help.

Do I need to wait 12 Months after the PR to apply for the Nationality or I can apply as soon as I get the PR as long as my wife Naturalised?.

You may apply for naturalisation directly after PR, if you are the spouse/civil partner of a British citizen and satisfy all the requirements.

Vinny already answered you - The answer is once you have PR (you don't have to wait 12 months) you can apply as a spuse of a British citizen.
