points

Post by Tsingh » Thu Jun 23, 2011 5:21 pm

I am living in UK under Tier 1 General Visa category.
On 30th march 2010 I applied for my initial Tier 1 visa application under old immgration rules, my application went successful and I got limited leave to remian in UK for 3 years(till 15/04/2013). Now I have a question in my mind, on my passport the visa issue date is- 15/04/10. So in Year 2013 when I apply for my extension of visa, do I still come under old Tier 1 category rules( Points calculations) or will new rules be applied on my application (i.e. after 06/04/2010). Please help me out with this query.

Like the main thing I am confused is with previous earnings. I have copied the below two earning chart`s from UKBA website and would lik to request you to please adivse me under which earning category table do I come.
"The table below shows the points that you will score if you currently have permission to stay in the UK as:
a Tier 1 (General) migrant under the Immigration Rules in place before 6 April 2010;
a highly skilled migrant;
a writer, composer or artist; or
a self-employed lawyer.
Previous earningsPoints
£16,000-£17,999 *5
£18,000-£19,999 *10
£20,000-£22,99915
£23,000-£25,99920
£26,000-£28,99925
£29,000-£31,99930
£32,000-£34,99935
£35,000-£39,99940
£40,000 or more45

If you are currently in another eligible immigration category, the table below shows the points that you will score:
Previous earningsPoints
£25,000-£29,9995
£30,000-£34,99915
£35,000-£39,99920
£40,000-£49,99925
£50,000-£54,99930
£55,000-£64,99935
£65,000-£74,99940
£75,000-£149,99945
£150,000 or more80

I mean say if I need to score 15 points under previous earnings section than what salary bracket would i fall under.

Please advise
Thanks :D

If you check the guidance and form at the time of extension it would explain all, but I think it would be the same at the time ofinitial application.

Thanks for reply...

The reason i am worried is because atm i am under 30k so if i do need to get 30K then I have to explain this to my company.

At the time of my initial application the previous earnings was 20K.

Thanks

You received your visa based on "the rules in place before 6 April 2010" as you applied 30 March. The important date for HO is date of initial application, not the date the visa is valid from.

Is there a tool similar to points calculator on UKBA website, which can give me a summary of points I earned during my first application using reference number on my VISA stamp ?

I agree with mulderpf comments, but when I use the points based calculator on BA website it asks for "Enter the date of your first successful tier 1 application" and when I enter 15/04/2010 as first successful tier 1 application it fails my points on previous earnings. It doesnot give me 15 points unless I put earnings bracket between £30,000 - £34,000.

Hence I am totally confused....

Do you guys know any home office email address, so that i can get in touch with because public enquires one is just sending me auto reply again and again.

Thanks
