Tier 1 Dependent Queries

Post by callelango » Fri Jun 24, 2011 1:50 pm

Dear Experts,

I am in Tier 1 for the past 5 months in UK and planning to apply dependent visa for my wife and daughter. I need a clarification on the following to plan accordingly.

Regarding maintenance funds as on today I have maintained 4800 GBP for 90 days and 6000 GBP for last 30 days.

I am planning to apply Visa for wife first, since I have less than 6000 GBP for 90 days. For example In july month I'll apply for my wife showing 4400 GBP (2800 + 1600).

Secondly I am planning to apply separately Visa for my daughter after 2 months. For example in September month I'll apply for my daughter showing 6000 GBP (2800 + 1600 + 1600)

Is the above will work without any refusal? Kindly advice.

Thanks In Advance,

Hi I am not expert but £4800 for 3 months is enough for both your wife and kid since you have already moved to UK. You do not need to apply separately for you kid. You can apply together. But make sure you have all other documents ready. Search though this forum about required documents. Now days dependent visa is getting refused for other reasons than lower maintenance.

Hi,As I have mentioned from all the text mentioned in the UKBA website and the example quoted in the dependent guidelines you need to show only 800 for yourself and 1600 for every dependents.

We have couple of members who have indicated that their visa was rejected and the reason quoted was that 2800 was not shown for the main applicant. However we also have members who have mentioned that their dependents visa was approve only with 800 for the main applicant. So we have both experiences shared by different people.

If I were you, I will do the following:
1. Try to keep 2800 for self. But will not make it as complicated as you are doing i.e applying once for wife and again for the kid. Unless you have a big reason to do.
2. I understand sometime family situation does not allow us to wait...........so I will write a mail to home office for this clarification and I expect their reply to quote 800 for self. I will attach that reply with cover letter while applying for dependent with maintenance fund of 4800 that you have (you will need 800+1600+1600 = 4000 to be precise)

So for you my suggestion would be:
1. Write to home office and seek clarification about how much you need to show
2. Once you get the reply and if it is 800 for self apply with a printout of this mail.

There might be members who will say........800 is enough and just go ahead........though I will agree but I also know how difficult it is to apply with uncertainty as the visa fees is big and you want your family to join soon and do not want to go through the hassle of re-applying/appeal etc.

But as mentioned in any case unless the reason is really big do not make it complicated by applying for your dependents in a gap of two months. Technically it seems perfectly fine as no rule tells you not to do it but I will definitely not suggest something like that.

Cheers,
Jacob

Thanks In Advance,

simple answer is YES. you need 2800 + 1600 +1600 = 6000 in your account for last 3 months

I Agree you need £ 6000 for 3 months until unless you have stayed for 12 months in UK in that situation you could have applied with £ 800 for you and £ 1600 for each dependent....its very clear in the set rules.

£2800 is only for people who didn't move to UK at all. Main applicant who is out side UK, needs to have £2800. If some one is already in uk they don't need to show £2800. Check the rules at http://www.ukvisas.gov.uk/resources/en/ ... rantdepend

But again since there is confusion and people got rejected because of Visa officer's lack of knowledge, its always better to be in safe side and choose the path where there is no confusion hence £6000 will be better.
