Naturalisation - Residence Period

Hi all

Would be greatful if you could give advice on my query

I got my HSMP on 16 June 2006
Got ILR on the 09 June 2010

I have booked an appontment with NCS for Naturalisation on the
10 June 2011

Will this count as 5 years completed or do I have to apply for Naturalisation after 16 June 2011

I think you will have to apply on or after 16th June 2011.

Did council people not ask you about your first arrival date etc? When I booked NCS appointment, the lady asked me all those quesions.

were you living/working in the UK on another type of visa ,before 16th June 2006

Why is their a discrepancy in the dates you claim you were granted settlement status? And the route to settlement?

You received ILR in June 2010, under HSMP JR:

When you got HSMP is irrelevant in ascertaining the date you may become eligible for naturalisation.

Hi

All depends the day you came to UK and under which visa it is. If you got your HSMP visa while living in UK then what is your previous visa status. If not then you are eligible after completing 5 years from the date you entered in UK not the date you got your HSMP. You can get more details here.

ur residence period starts from ur first entry to the uk not ur visa date means if u get visa on 16 june and u come to uk on 18 june so ur residence period will start from 18 june

Hello Khankhattak ,
How did your case go? Mine is similar to yours.
I came into the UK 14/1/2006 on students visa.
I spent a month outside the UK for my HSMP entry clearance and came in fully on HSMP on 23/8/2006.
I got ILR on 26/7/2010.

Please can I apply for naturalisation on 26/7/2011?
or wait for 23/8/2011

The question is really IF THE 7 MONTHS I SPENT AS A STUDENT before changing to HSMP counts towards the 5years residence requirement for Naturalisation or if it is only the period spent on the HSMP scheme.?

Please I welcome every one's advise.

Please give the exact date you left the UK, before you returned to the UK on 23.08.06.

i think john they way you guide me and i applied littler earlier then he/she can apply little earlier aswel as long as not exceeding the absence and other requirement should be completed.

Nazia, i am concerned that he might fail the "applicant was physically in the UK exactly 5 years before UKBA receive the Naturalisation application" test. UKBA have no discretion about that particular test.

Also we need to take on board "I got ILR on 26/7/2010.".

I came back to the UK 23/8/2006....56 days in all

You were outside the UK 5 years ago, and therefore cannot possibly apply now.

You returned to the UK on 23/8/2006 and therefore will need to wait until shortly after 23/08/2011 before you apply.

Hello John,Thanks for your response.
I was only out of the UK for abt 58 days, I know you cannot stay outside the UK for more than 450 days in the 5 years period, and not more than 90days in the 12 months before you apply for naturalisation.
I just want to know if the period I spent as a student will count towards the 5 years naturalisation requirement or if it must be only period spent under HSMP. I changed my mind on studies and decided to apply for HSMP instead while in the UK, but had to go to my country for entry clearance.

Any legal time in the UK can count towards Naturalisation, even time in the UK as a visitor.

But you are in great danger of ignoring the existence of a very important rule. That is, it is an absolute requirement that you were physically in the UK at the start of your 5-year qualifying period. UKBA have no discretion about this particular rule!

So as it is currently the case that you were outside the UK 5 years ago, you cannot make a successful Naturalisation application at the moment. So as I said earlier you "will need to wait until shortly after 23/08/2011 before you apply".

When does the residential qualifying period start?

The residential qualifying period is calculated from the day when we receive your application. Most unsuccessful applications fail because the applicant was not present in the UK at the beginning of the residential qualifying period. You must make sure you meet this requirement before you make your application. For example, if we receive your application on 25 March 2010, you must show that you were in the UK on 26 March 2005.
