Student Visa expires - Waiting for de facto application

Post by robbie123 » Wed Jul 06, 2011 12:34 pm

Hi all,

Just wondering what to do in this situation: My partner's student visa will expire soon (unlikely to be renewed as its valid for 3 years now).

We have recently sent all documentation for to apply for de facto relationship status and are waiting for the result, so we have started a process with the department.

I'm wondering what to do about his student visa expiration because obviously he does not wish to be here illegally. Will they extend his visa while we wait for an answer on de facto app? Do we need to go to GNIB and explain, or is it an obvious consequence of the application we have made using his Department number, and therefore it is unlikely to cause future problems as it is in their system?

Any guidance in this situation would be much appreciated.
Thanks,
