Yes by the looks of it he cannot as he has stamp4 until 2014. That above long term residency isn't just exactly means LTR permission but also any sort of long term residency visa like IBC/Zambrano or Spouse of EU/Irish etc imho.IMPORTANT ANNOUNCEMENT
From 1 December 2010 we will no longer accept Without Conditions As To Time applications from people who have a stamp 4 and already have a long term residency in the State. You can only apply for WCATT if your Stamp 4 permission has less that 6 months to run.

my husband's stamp 4 is not long term residency stamp so should he wait until 6 months to go to expire of current stamp 4 IBC or entitled to apply for it right now within 96 months of legal residence? Thank you.
