PEO Appointment for tier 1 extension

Hi Guys,

Hope some one will answer this.

Is it ok to book an appointment 16 days before my current visa expires or shall i book an appointment on the day when my visa is due to expire?

I am not sure whether they give visa from the day when your current visa expires or from the same day when you have an appointment booked with them.

Please clarify i dont want to put my self in the situation where i am short of my 5 years and apply for one more extension.

Any response from senior will be great help.

You can apply up to 5 weeks before ur leave expires and ur new visa should start from the date the previous one expires so you should be fine..

My friend had booked an appointment 20 days before his visa expires and his new visa started from the day when he had an appointment booked at PEO.

Are you sure about that they should give you visa from the date when your visa expires ?

Is there any senior who can respond to this query please ?

really, bcos i made my PEO exactly a month prior to the due date as well. wld love to find out as well, it would be great if someone could help on this, thanks.

yeap khccheng.

His appointment was in croydon PEO. I guess different PEOS have different way of working. But in my opinion it should not happen they should give you visa from the date your visa expires as long as you are not making your application more then one month early.

That is why i am asking to seniors if they know something which we dont know?

BTW, When is your appointment booked ?

I am qouting from my own experience. I went to PEO croydon 6 weeks before expiry and got extension from the previous expiry date. However mine was last year june so maybe they are more strict now. give them a call or send them an email

My guess is that could be the reason as you have applied last year things were bit different that i dont think it's same any more.

Its better to apply in advance to avoid the possibility of rejection on last day and you having to run amok putting together a new application before you become an illegal migrant the next day.

You will get the visa on the day you attend PEO
e.g. your appointment on 10th Aug.
visa expiry- 30th Aug.
then your new visa should be 10th Aug- 2011- 30th Aug. 2013
You should get your current visa time added to new visa if you apply near to your visa expiry.

u need to assume that u will get your visa start date on the same day as your PEO appointment, I would also make sure you are within the 28 days of the 5 years, so it also depends on when you entered the country.

u need to count the days you have been in the country,

so if you entered the UK say 3 weeks after your visa start date you then need to apply for PEO 1 weeks before your visa expires. Applying earlier than 1 week you run the risk of been short days for the ILR rule, which needs to be within 28 days of 5 years

applied 5 weeks before expiry date via PEO, the approval date i got was the date the visa was approved not from the previous expiry date...

T90 I presume you are now short of of couple of weeks for ILR and will need a 2nd extension correct?

hi mtuckersa,

Thanks for the info just want to let you know i was already in this country on IGS visa when i had my tier 1 stamped initially.

And i am going to book an appointment for extension just before 15 days my current visa expires so in my opinion i think i will be fine for my ILR application i dont think i will need another extension to make up my 15 days what do you think ?

like i said should not be a problem as long as you have 4 years 11 months and 3 days in the UK, then application for ILR is fine

nope 4 years 11 months and 3 days = 28 days before 5 years

One important information you must remember. If you have first entered in UK within 3 months of grant of leave, then even if you are not completing 5 years, you will still be granted ILR.

For eg. assume your first Tier1 was granted 1st June 2008 and you entered UK for the first time on 25th August. And then assume your extension is granted from 1st June 2011 to 31 May 2013. Then although you are not completing 5 years on 31 May 2013, you are still allowed ILR.

See the guidelines for the case workers here. See page 44, section 2.2. It says the following:

2.2 Applications that fall short of the five year continuous period
In some cases, applicants may have been granted 5 years continuous leave, but will not have
spent 5 years continuously in the UK before their current leave expires. Caseworkers may
count the period between entry clearance being granted and the date the applicant entered
the UK towards the 5 years, provided this period was not longer than 3 months.
