ILR due date a quick question

Post by dr_raihan29 » Wed Jul 27, 2011 12:38 pm

Hi there guys, sorry for the trouble again but as the date for the application for ILR is drawing near different(may be daft) questions are cropping up in my mind.
My HSMP(JR april-nov) visa stamp was stamped on 18th oct 2006 but the visa started 14th of Nov 2006.(I was already incountry with PFT visa when I applied and PFT was still valid on 18th oct). Should I count my 5 yrs from the date visa was stamped or the date of commencement of the visa as I was already incountry. And if 14th Nov is the expiry of my current tier 1 leave when should I start looking for PEO appt?( I live in belfast but aiming Sheffild or croydon or birmingham)

thanks in advance for your replies

Did you mean 14 OCt instead of 14 Nov? Any case, your 5 year period starts from the day visa is stamped in passport (as its incountry application). If that date was 18th Oct 2006, then you finish 5 years on 18th Oct 2011 and you can apply up to 28 days befoer 18th oct 2011. They usually release appointments 6-7 weeks in advance but it may take some time to find one. so better to start looking earlier (around 8 weeks) and seeing if a patern of new date release emerges then you can get one appointment which u need.

many thanks for the reply xyz123, there are 3 dates on the visa stamp

visa stamped 18th oct 2006
visa commenced 15th nov 2006
valid until 14th nov 2008

its a bit confusing because I always thought as PFT doesn't count for ILR and "The period on which this application for ILR is based on" thing starts on the 15th it has to be 28 days from 15th nov 2011, is it stated anywhere on the website(would be grateful if you could paste a link) which states that for incountry applicant with valid leave its the date of stamping(approval) that matters??

thanks again
raihan

Look at section 5. It says the date on which the visa was granted and that is usually taken as date on which visa started from:

Dont hijack other's posts. I would say it wold be 2nd nov (assuming it was an incountry application), If out of country then your 5 years start from the date you enter the UK for fist time on qualifying visa.
