My reasons for refusal are below

2)
Experience Claimed 35 ( Awarded 0)
Evidences
a)Reliving letter and Exp letter Employer 1 (4 yrs 10 Months)
b)Reliving letter of emploer 2 (1 yr) - Sr software Engineer
b)Roles and Responsibilites letter Current Employer(1 yr +)
PS: I couldn't get exp letter from employer 2 and I thought min point I can get is 25 (As 5+ years exp)

Reason for refusal:
They have stated they are not satisfied that my work is a graduate level experience.
I have referred to 'case worker manual".In my view, I am thinking this is since "telecom testing and Test Automation" are not listed there. I have explained them my job in detail and the somehow I tried to convience them it is a "Complex" job..:)..

many of my colleagues got HSMP with the same work that I am doing.
For IT employees, I think it is very important somehow to inlcude the same terminologies as mentioned in "case worker manual"

3) Earnings Claimed 25 ( Awarded 0)
a)Appointment Letter of Current Employer with Salary Details 9 1 yr old)
b)Tax retuns filed for year 2005-2006 (Apr to Mar)

Reason for refusal: ( I feel this is really a stupid reason)
They have said "Salary in tax returns certificate and in employer letter" do not match.
My employer letter includes my PF and Medical reemurshment components.

I have given them enough explanation.
I think it is better to send "payslips and Tax returns" as they always match.

I am not 100% sure if my review request works..Since it is free, i have applied ..:)[/u]

Hi,

I am from India & under 28yrs and i had to show my salary 5000+ GBP.
My case is rejected on the basis of salary.
I just wanna know what you have shown in that section, i had sent the following:

Last 12 months salary statements (verified by present employer)

Last 12 months ORIGINAL bank statements

Last year INCOME TAX PROOF (that contains salary from April - March cycle)

An attached excel sheet showing "how to calculate my salary"

I have shown that i had earned 5392 GBP but they have calculated as 4717 GBP.

And heading which were included in my salary slips are:

Basic
HRA
Conveyance
Special pay
Non taxable amount
Bonus
Leave encashment

bonus -> we get this in the month of JAN on the basis of our performance

Non taxable amount -> in this section , we have to give bills (like fuel bills / medical bills / magzine bills )

Special pay -> this we get when we havn't submitted required bills , then our company deduct tax on that left "Non taxable amount " , and gives that left amount as special pay at the end of financial year (in march)

Leave encashment -> this we get on our earned leaves , at the end of financial year(in march).

Points i got :
25 -> education
5 -> age
25 -> exp

Can you pls suggest me where I have gone wrong ???

what should i do for review for following 3 sections

Post by ebrij » Fri Aug 25, 2006 7:41 am

I HAVE APPLIED FOR HSMP UNDER 28 FROM INDIA,AHMEDABAD

APPLICATION SENT ON 14TH JULY VIA DHL,
APPLICATION RECEIVED AT HOME OFFICE ON 18TH JULY.
PAYMENT CLEARED ON 27TH JULY
REF. NO RECEIVED BY E-MAIL ON 9TH AUGUST.
DECISION MADE ON 16TH AUGUST -- CONFIRMED OVER PHONE.

Document received at my PO Box Today: 23/08/2006.

Net days for File Processing: 35 Days

I got 55 points out of 95 claimed.

Following is the description given in refusal letter.

Academic Achievement - 15 points awarded.

Work Experience - 35 points awarded.- CLAIMED 50
We were not satisfied that sufficient evidence was provided to demonstrate that your previous work experience involved 1 year specialist or senior level work experience.
The HSMP guidance state that senior level work experience would normally be a role at board level within a small company where there would be evidence of your active involvement in the day to day running of the company. For a larger company, the expectation is that evidence is provided to demonstrate that you have ultimate control a sector of the business such as Department Head or leader of a project management
team. A specialist position is one that would require a very high level of technical or artistic expertise. Therefore points have been awarded accordingly for graduate level work experience.

Earning Criteria - 0 points awarded.
Points not claimed.

Achievement in Chosen Field - 0 points awarded.
Points not claimed.
“ THOUGH I have CLAIMED 15 POINTS“

HSMP Priority - 0 points awarded.
Points not claimed.

Age Allowance - 5, points awarded

Skilled Partner. - 0 points awarded. [ CLAIMED 10 POINTS ]

The evidence supplied did not support your claim for 10 points for this section. The HSMP guidance states that evidence is required to demonstrate that the applicant's spouse is educated to degree level or employed in a graduate level post. Your application form states that your spouse has been employed at graduate level. The evidence to support this claim must be, 'original employer references on letter headed
paper. They should include the start and end dates of each position held during the employment together with the job title and a full description of the duties and responsibilities held'. We were not satisfied that the reference provided demonstrated that your spouse is currently working in a post that necessarily requires a degree level qualification.

Insufficient supporting evidence was provided for the points to be awarded. The HSMP guidance states that the applicant must supply 3 pieces of evidence to demonstrate that they and their long term partner have been living in a relationship of either marriage, civil partnership, or a relationship akin to marriage, that has subsisted for at least the last
2 years. The evidence must confirm that you have been living together at the same address for this 2 year period. (Married couples should provide their marriage certificate as one of the pieces of evidence. Civil partners should provide their civil partnership document. The guidance notes give a list of suggested documents. The evidence provided with the application does not demonstrate that these requirements have been met. No forms of correspondence to cover the time period of 2004,2005 and 2006 was
submitted as evidence. Therefore we were unable to award points for this section.

What Should I Do now ?????
i am 10 points shortage only ""

TRY FOR additonal 15 points for Work EXP. [ 50 points ]
TRY FOR 15 points of achievement which they have missed ??
TRY FOR 10 points of Spouce.

One another problem for Spouce is that i got married on April , 2006. so how i could get 2 years relationship evidances.

Expert advice needed.

Hi ebrij
I think you just need to do little home work and apply again with all supporting documents. i think you can make it.

you have to work on these points.

1- Skilled Partner

You can get these point if you are married for more than 2 years. please try to arranage proof for these. marriage certificate in orginal you can attach your ID's, Passport of you wife with your Last name or and any other document which shows that you are togather with your wife from last 2 year.

now 2nd part of this section is to show that your spouse is skill and doing a graduate level job. for that if your wife is doing Graduate level job then try to get all these document

1- Her degrees (Which can be eqvilent to UK bechelors) for that you can get Eqvulence certificate from NARIC. if you dont want to get NARIC then you have to make sure that her degrees are eqvilent to required standerd, that you can do if you know somebody with same degree gettiing through from HSMP process.

2- Once you are done with Degree thing you have to get experience certificate from her employers where she is working. and make sure it should be very detailed. for the reference please check Caseworker guidence which clearly explain what kind of information you need to mention in your experiece letter

i hope this will help you

good luck

review request query

Post by pranav_mathur » Mon Aug 28, 2006 6:49 pm

Hi All,

I want to confirm couple of things:

1) For review I need to send the review form along with a letter explaining why I think a review is required. There is no need to send another document. Please confirm.

2) The review request can be sent by post, fax or email.

 By post its OK. It seems simple enough.
The address I have is:
HSMP Team
PO Box 3468
Sheffield
S3 8WA

Is there any seperate address for courier?

 I have read it in the forum that if a request is sent by fax then it is advised to call them up to inform that review request has been faxed.
I have a fax number (+44 11 42 59 38 27) but in this discussion thread I saw another number (+44 11 42 07 60 21) , can anyone confirm which is the correct nmber and also tell me the number which I should call up after sending the fax to confirm the delivery.

 I have the email address "hsmp.workpermits@ind.homeoffice.gsi.gov.uk", can anyone confirm that this is the correct email address where I can send the review request.
Has anyone used this medium for sending their request? It seems to be the most convinient method, any disadv of this??

Thanks in advance for answering my queries.

Dear Members,

I got REFUSAL,
Today I got my documents from USP, I arranged courier (MBE Mail Boxes Etc) to collect my documents
It cost me pound 71/- as pound15/- for collection and pound 56/- for sending it to KSA.
Points claimed
Education - 15 Awarded 15
Experience – 50 Awarded 0
Earning – 25 Awarded 25

The case workers comments are as follows :

“The reference that was supplied for XXX Company was insufficiently detailed to determine the individual, specific duties within the said responsibilities of the post to consider the level of employment that you are currently working at and therefore this could not be awarded.”

Senior members can you help.

In KSA there are specific formats for Experience certificates, I tried my best to get the format which is as per the HSMP requirement means very detailed one, but the employer is very much stick to their practices. When I insist too much they gave me the experience certificate with some detail.

Now could you please give some tip or suggestion to convinced HSMP of this practice and request them to award me at least the graduate level work experience.

Your tips will be helpful and make my review application strong

So sorry about your refusal.

I think review will not work in your case becos if they want you to submit more details then i think its better to provide them, so you cannot provide new evidence with review request. and 2ndly reivews are taking too much time as if you take my experience, i am still waiting and now its more than 4 month since i have applied for review.

Now about your company, if you have told them that you have applied for HSMP then i think there is nothing to worry.

just take your refusal letter and new detail format to your employer and explain whole situation to them. and tell them that UK HO want detailed letter in given required format. Even you can offer your employer that they can write a line at the top that this specific letter is issued for Just Home office request or use, instead of To Whome it may concern.

I hope by this they will agree to issue you a letter.
