Getting a Tier 2 (ICT)

Hi,

My query is this: I am outside EEU but I work in a company in my country that is based in UK. Can I get another job in UK under Tier 2 ICT if I keep working in this same Company?

If yes, then two other questions arise.

Would it matter if the area of expertise change, like Marketing to Journalism in my case.

Would it also matter if, in the process, I change from one division to another division of the same company?

Yes. The general spirit of the ICT visa is that there is a temporary transfer of expertise, unique to the company, that can't be found hiring local talent or with existing local employees. Thus by changing fields entirely, it would be difficult to show that you are transferring any company-specific expertise. Afterall, you hadn't even worked in that field, much less that particular department in the company. I don't want to state that it is impossible though. It may be that your journalism department in the UK is in dire need of specific marketing experience with the unique corporate touch, say for advertising purposes. I'm just saying that your company would really have to demonstrate this need.

This is not a problem. In fact, this is the expected result i.e. that you would transfer, temporarily, from one part of the company to another (hence the name of the visa Intra Company Transfer).

I have stressed 'temporarily' because this visa is not a path to settlement in 5 years as it used to be.
